DAN ROSALES
Dan Rosales is a litigation Partner at ESCA Legal and a nationally recognized IP enforcer, where he helps established global brands and the next generation of market disruptors protect their most valuable assets. A New York attorney with over a decade of experience, he litigates complex trademark, trade dress, and copyright matters in federal courts, arbitration tribunals, the USPTO's Trademark Trial and Appeal Board, and the WIPO Arbitration and Mediation Center.
Dan serves as strategic IP enforcement and litigation counsel for leading brands across a range of industries, including food and beverage, consumer packaged goods, premium chocolate and confectionery, specialty coffee, luxury goods and design, fashion and lifestyle, and emerging technology. His work spans trademark and trade dress enforcement, unauthorized reseller disputes, copyright protection, and brand equity protection at scale, and he advises clients on the intellectual property issues arising from artificial intelligence and large language model offerings. A dedicated enforcer, he is equally at home protecting household names and helping younger brands establish and defend their rights.
Dan represents major consumer brands including household names in the beverage, coffee, and nutrition categories. He leads high-stakes trademark and trade dress matters in federal courts across the country, including the Southern and Eastern Districts of New York and the Northern and Central Districts of California. He has been recognized as a Rising Star by Managing Intellectual Property (2024–2025) and has been listed as a New York Rising Star by Super Lawyers every consecutive year from 2022 to the present.
Outside the office, Dan is a devoted Los Angeles Dodgers fan. He and his wife share a passion for rescue animals and open their home to senior dachshunds in need of a loving family. Dan enjoys taking his family to see new places and spending time in the New York City community, and many of his weekends are spent exploring Central Park and visiting the Met. He is currently learning French with his son.

He has represented established global brands and emerging market disruptors in trademark, trade dress, and copyright matters before federal courts, arbitration tribunals, the USPTO's Trademark Trial and Appeal Board, and the WIPO Arbitration and Mediation Center, with particular depth in the food and beverage, consumer packaged goods, luxury goods, and emerging technology sectors.
Dan earned his J.D. from Cornell Law School, where he was named to the Dean's List, and his B.A. from Occidental College.
